By creating an account, accessing, or using the platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the platform.

2. Eligibility and Access

The app is open to anyone aged 18 years or older. Users do not need to be employed in hospitality to download or use the app. However, access to the full experience, including exclusive offers, discounts, and certain events, requires verification that you are currently employed within the hospitality sector ('Verified Member'). Verification is completed by submitting an acceptable form of employment evidence such as a recent payslip showing your name and employer. Cellar Club reserves the right to approve, deny, or revoke verified status at any time.

3. User Accounts

You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your login details and any activity under your account. You must notify us immediately of any unauthorised access or security breach. We reserve the right to suspend or terminate any account that breaches these Terms or is suspected of fraudulent or abusive behaviour.

4. User Profiles and Job Opportunities

Users may create and maintain a career profile, including uploading a résumé, listing job history, and updating experience details. This information will be visible only to authorised Cellar Club staff and administrators. By uploading career information, you consent to Cellar Club using it to recommend relevant job opportunities, contact you directly regarding potential roles or industry connections, and share anonymised or aggregated data insights with hospitality employers or partners. Cellar Club does not guarantee employment or job placement outcomes.

5. Offers and Redemptions

Verified Members may access exclusive offers provided by participating venues. Offers are created, managed, and fulfilled by the participating venues themselves. Cellar Club does not guarantee the availability, accuracy, or continued existence of any offer. To redeem an offer, members must follow the instructions outlined within the app — e.g., displaying their digital membership card or using the in-app self-redemption process. Offers may have conditions, time limits, or exclusions determined by the venue. Misuse of offers or fraudulent activity may result in account suspension or termination.

6. Events and Competitions

Cellar Club may run events, ticket giveaways, or competitions accessible through the app. Entry requirements, closing dates, prize details, and any additional conditions will be stated in the relevant event or competition listing. By entering, users agree to the stated terms and any applicable eligibility rules. Cellar Club reserves the right to cancel or modify any event or competition at its discretion.

7. Venue and Brand Partner Terms

The following applies to all businesses ('Partners', 'Venues', or 'Brands') participating in Cellar Club: Partners must ensure all offers, discounts, and promotions listed on Cellar Club are accurate, valid, and up to date. Partners retain full responsibility for the fulfilment of their offers, including pricing, availability, and service delivery. Partners must ensure all participating staff understand the offers and apply them correctly at the point of sale. Cellar Club is not responsible for disputes between venues and users, including pricing errors or service issues. Partners confirm that they have the authority to publish and deliver the offers listed. Partners must not upload or promote offers that breach any applicable Australian laws, including those relating to liquor licensing, employment, or advertising standards. Cellar Club reserves the right to remove any venue, offer, or listing that is misleading, expired, or inappropriate.

8. Data Collection and Privacy

Cellar Club collects and processes personal data including, but not limited to, names, contact information, employment verification details, and résumé content. Data is used to verify eligibility, personalise app experiences, and facilitate career matching. All data handling complies with the Australian Privacy Principles (APPs). A detailed Privacy Policy explaining data use, storage, and user rights will be available separately on our website.

9. Intellectual Property

All trademarks, logos, and branding, including the Cellar Club emblem, designs, and imagery, are owned by New Order Media Pty Ltd. You may not reproduce, modify, or distribute any content from the app or website without written consent. Partners may use the Cellar Club logo only in accordance with approved brand guidelines and with prior permission.

10. Prohibited Conduct

You must not: provide false information or attempt to gain verified access fraudulently; misuse or share membership access or offers with non-members; engage in conduct that could damage the reputation of Cellar Club, venues, or other users; or interfere with or attempt to disrupt the app or its servers.

11. Disclaimer and Limitation of Liability

The Cellar Club platform is provided 'as is' and 'as available'. We make no representations or warranties regarding the uninterrupted availability or accuracy of offers or content. Cellar Club does not endorse or guarantee the quality, safety, or legality of any venue or offer. To the fullest extent permitted by law, Cellar Club and its affiliates are not liable for any loss, injury, or damage arising from your use of the app, participation in an offer, or attendance at a venue. Nothing in these Terms limits your rights under the Australian Consumer Law.

12. Indemnity

You agree to indemnify and hold harmless Cellar Club, its directors, employees, and affiliates from any claims, damages, or losses arising out of your breach of these Terms, misuse of the platform, or violation of any law.

13. Termination

We may suspend or terminate your account or verified status at any time if you breach these Terms or misuse the platform. You may deactivate your account at any time via the app or by contacting [email protected]. Upon termination, your access to offers and verified benefits will cease immediately.

14. Changes to These Terms
